Introduction

Welcome to KolsHouse (the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Platform. By using the Platform, you agree to be legally bound by these Terms. If you do not agree to these Terms, you shall immediately cease using the Platform.

License

Subject to these Terms, KolsHouse Consulting and Marketing Solutions Ltd. grants you a limited, non-exclusive, non-transferable, revocable license to use the Platform solely for your personal, non-commercial use. Any commercial use is strictly prohibited without prior written consent from KolsHouse.

User Responsibilities

You shall not engage in any activity that could harm the security, integrity, or functionality of the Platform. You are solely responsible for any content you post on the Platform and agree to maintain the confidentiality of your account credentials. Unauthorized access or use of the Platform by any third party through your account shall be your responsibility.

You further agree not to:

• Modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or sell any part of the Platform's content without express written permission from KolsHouse. • Use the Platform for any unlawful or prohibited purpose, including but not limited to activities that infringe on the intellectual property rights of others.

Intellectual Property Rights

All intellectual property rights, including copyrights, trademarks, and patents related to the Platform and its content, are owned by or licensed to KolsHouse Consulting and Marketing Solutions Ltd.. You acknowledge that by using the Platform, you acquire no rights in any intellectual property except for the limited license granted under these Terms.

You shall not:

• Copy, modify, reproduce, or distribute any part of the Platform without prior written permission from KolsHouse. • Use any part of the Platform to create derivative works or engage in any activities that could infringe on KolsHouse’s intellectual property rights or those of its licensors.

User-Generated Content

You retain ownership of the content you submit or post on the Platform. However, by submitting content, you grant KolsHouse a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, and distribute your content in connection with the operation and marketing of the Platform.

Limitation of Liability

To the fullest extent permitted by law, KolsHouse Consulting and Marketing Solutions Ltd., its affiliates, officers, directors, employees, agents, or licensors shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses. This includes any damages arising from:

(i) Your access to or use of, or inability to access or use, the Platform; (ii) Any conduct or content of any third party on the Platform; (iii) Any content obtained from the Platform; and (iv) Unauthorized access, use, or alteration of your transmissions or content.

In no event shall KolsHouse’s aggregate liability exceed the amount you have paid, if any, to access or use the Platform in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless KolsHouse Consulting and Marketing Solutions Ltd., its affiliates, officers, directors, employees, agents, and licensors from any and all claims, demands, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

(i) Your use or misuse of the Platform; (ii) Your violation of these Terms; (iii) Any content you submit, post, or transmit on the Platform; (iv) Your violation of any third-party rights, including intellectual property rights.

Termination

KolsHouse reserves the right to terminate or suspend your access to the Platform at any time, without prior notice, for any violation of these Terms or for any reason at its sole discretion. Upon termination, all rights and licenses granted to you shall immediately cease, and you shall promptly cease all use of the Platform.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms shall be exclusively resolved by the competent courts of Turkey.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Changes to the Terms

KolsHouse Consulting and Marketing Solutions Ltd. reserves the right to modify or update these Terms at any time. Any changes shall be posted on the Platform, and users are encouraged to review these Terms periodically. Continued use of the Platform after any updates shall constitute your acceptance of the modified Terms.
