End User License Agreement (EULA)

Introduction

This End User License Agreement ("Agreement") is a legally binding contract between you ("User" or "You") and KolsHouse Consulting and Marketing Solutions Ltd., a company based in Turkey ("KOLS.HOUSE", "we", "our", or "us"), governing your use of the KOLS.HOUSE platform, including all related content, software, data, services, and intellectual property (collectively referred to as the "Platform").

By accessing or using the Platform, you accept and agree to comply with the terms and conditions outlined in this Agreement. If you do not agree with any of the provisions in this Agreement, you must immediately cease all access to and use of the Platform.

Grant of License

Subject to your compliance with the terms of this Agreement, KOLS.HOUSE grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes only. All other uses of the Platform are expressly prohibited without prior written consent from KOLS.HOUSE.

Intellectual Property Rights

All intellectual property rights, including copyrights, trademarks, patents, trade secrets, and any other proprietary rights, in and to the Platform and its content are owned by KOLS.HOUSE or its licensors. This Agreement does not transfer any ownership rights to you. You acknowledge and agree that any unauthorized use, reproduction, or distribution of the Platform or any of its content shall constitute a violation of applicable intellectual property laws and shall result in legal consequences.

You are expressly prohibited from:

• Copying, modifying, distributing, or creating derivative works based on the Platform or its content. • Decompiling, disassembling, or reverse engineering any part of the Platform. • Renting, leasing, or sublicensing your access to the Platform. • Circumventing or attempting to circumvent any technical protection measures used to control access to the Platform or its content. • Using the Platform to infringe on the intellectual property rights of any third party.

Platform Modifications and Updates

KOLS.HOUSE reserves the right, at its sole discretion, to modify, suspend, or discontinue any aspect of the Platform, including its content, features, and functionalities, without prior notice. You agree that KOLS.HOUSE shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

Termination of License

This Agreement is effective from the date of your first use of the Platform and shall remain in force until terminated. KOLS.HOUSE reserves the right to terminate or suspend your access to the Platform, at its sole discretion, for any violation of this Agreement or for any reason without prior notice. Upon termination, you must immediately cease using the Platform and destroy any copies of materials you have obtained from the Platform.

Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis, without any warranties or guarantees of any kind. KOLS.HOUSE expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing, usage, or trade practice.

We do not guarantee that the Platform shall be free from errors, viruses, security vulnerabilities, or interruptions. KOLS.HOUSE is not responsible for any harm resulting from your access to or use of the Platform, including any damage to your computer system or data.

Limitation of Liability

To the fullest extent permitted by law, KolsHouse Consulting and Marketing Solutions Ltd., its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages. This includes but is not limited to loss of profits, revenue, data, or goodwill arising out of your use of or inability to use the Platform, even if KOLS.HOUSE has been advised of the possibility of such damages.

In no event shall the aggregate liability of KOLS.HOUSE and its affiliates exceed the amount you paid, if any, for accessing the Platform in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless KolsHouse Consulting and Marketing Solutions Ltd., its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Platform, your violation of this Agreement, or your infringement of any third-party rights, including intellectual property rights.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Turkey for any legal disputes arising out of or related to this Agreement or your use of the Platform.

Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of this Agreement shall remain in full force and effect.

Entire Agreement

This Agreement, together with our Privacy Policy and Terms and Conditions, constitutes the entire agreement between you and KOLS.HOUSE regarding your use of the Platform and supersedes all prior agreements or understandings, whether written or oral, related to the subject matter hereof.
